PLZR SAS (“PLZR”, “we”) values the protection of your personal data. This policy explains what data we collect on shop.vitaperf.com and in your customer account, why, how long we retain it, with whom we share it and how to exercise your rights. It supplements article 14 of the Terms and Conditions of Sale and applies under Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.

2. DATA COLLECTED

Depending on your use of the Site, we collect the following data directly from you or automatically during browsing:

  • Identity and contact details: surname, first name, email address, telephone number, delivery and billing addresses.
  • Orders and subscriptions: products, quantities, amounts, dates, order reference, delivery status, renewals, cancellations, returns and refunds.
  • Payments: transaction status, card type and last four digits, transaction identifier. Your full bank details are entered through Stripe's secure interface: we do not access or retain them.
  • Customer account: login credentials and history of your requests.
  • Customer Service correspondence: emails, requests and photographs you send us.
  • Browsing data: IP address, device and browser type, pages visited, visit source, identifiers from cookies and trackers (article 7).
  • Preferences and consents: communication channels accepted or declined, date and time, collection page or form and wording presented, any withdrawals.
  • Call data, if you consented to being called or a call relates to your order: number called, date, time, call outcome and, where applicable, recording.

Required fields are identified when data is collected; without them, we cannot process your order.

Health data and private life. We do not request health data or information about your sex life. Purchasing certain products may nevertheless reveal such information: we therefore treat order information with enhanced confidentiality, restrict access to those who need it and use it only for the purposes described below. If you voluntarily provide health information (for example in a Customer Service message), it is used only to handle your request.

4. COMMERCIAL COMMUNICATIONS

In addition to order-related messages, you may receive commercial emails and text messages and calls from telephone advisers in the cases described below. A “prospect” is someone who has provided contact details (form, test, registration, abandoned cart, etc.) without placing an order.

4.1 Order-related messages. Emails and text messages about confirmation, dispatch, tracking, reminders before renewal, payment problems or replies to your requests. They are necessary for performance of the contract and are not commercial messages: you receive them while your order or subscription is ongoing.

4.2 Commercial emails and text messages.

  • If you are a prospect, we send them only with your consent, collected through an unticked checkbox when you enter your details.
  • If you are a customer, we may send offers for products similar to those you bought without prior consent, provided you could object free of charge when your details were collected and can do so in every message.
  • Each email contains an unsubscribe link and each text message includes instructions for unsubscribing free of charge (for example “STOP”).

4.3 Calls from telephone advisers

  • Prior consent: we arrange commercial calls only to people who accepted them through a dedicated, unticked checkbox separate from other communication channels. This checkbox identifies PLZR, the nature of the products concerned and your right to withdraw consent.
  • Who calls you: telephone advisers appointed by PLZR, acting on our behalf and instructions, who identify themselves at the start of the call. Your consent applies only to products sold on shop.vitaperf.com; it does not extend to other companies or brands without separate agreement.
  • Duration: your consent is valid for no more than one year from collection and is not automatically renewed. After that period, we no longer call for marketing purposes unless you give fresh consent.
  • Days and times: Monday to Friday, excluding public holidays, from 10 to 13 and 14 to 20 in your time zone, with no more than four solicitations in any 30-day period, unless you expressly asked to be called at a specific date and time.
  • Calls related to your order or subscription: we may call without specific consent where the call concerns performance of an ongoing order or subscription (delivery tracking, payment problems, subscription information or related complementary products).
  • Data shared: the telephone adviser company receives only the contact details and information necessary for calls to which you consented or which relate to your ongoing contract.

4.4 Withdrawing consent or objecting. At any time, free of charge and as easily as you gave consent:

  • email: use the unsubscribe link at the bottom of the message; text message: reply “STOP” or follow the unsubscribe instructions;
  • telephone: simply tell the adviser during the call; an oral request is sufficient and we act on it promptly;
  • online: through your customer account or by email to support@shop.vitaperf.com.

Withdrawing consent does not affect order-related messages or the lawfulness of previous processing. You may obtain evidence of your consent free of charge, without creating an account (date, time and information presented), by writing to support@shop.vitaperf.com.

5. RECIPIENTS OF YOUR DATA

Your data is accessible to authorised PLZR personnel and, as necessary, to our service providers, who act on our instructions under contracts complying with article 28 GDPR:

  • our logistics partner and carriers (parcel preparation and dispatch, returns);
  • Stripe (payments and recurring payments). Stripe also acts independently as a separate controller to prevent fraud and comply with regulatory obligations (https://stripe.com/fr/privacy);
  • our hosting, maintenance and IT security providers;
  • our email and text message providers and customer relationship and Customer Service tool;
  • the telephone adviser company, for calls described in article 4.3;
  • audience measurement tools and advertising platforms, only if you accepted the corresponding cookies (article 7);
  • our advisers, bailiffs, debt collection companies, banks and payment providers in cases of non-payment or disputes;
  • administrative and judicial authorities where required by law.

PLZR does not sell your personal data.

6. TRANSFERS OUTSIDE THE EUROPEAN UNION

Some providers (such as Stripe or marketing tool providers) may process data outside the European Economic Area. These transfers are governed by a European Commission adequacy decision (including the Data Privacy Framework for the United States) or standard contractual clauses supplemented where necessary by additional measures. You may obtain a copy by writing to us.

7. COOKIES AND TRACKERS

The Site uses two categories of cookies and trackers:

  • strictly necessary (cart, session, security, payment, fraud prevention): placed without consent;
  • audience measurement and advertising: placed only with your consent, collected through the banner displayed on your first visit.

Refusing is as easy as accepting. You may change or withdraw your choices at any time through the cookie management module available on the Site or by configuring your browser. Cookies last no more than 13 months and browsing data is retained for no more than 25 months.

8. YOUR RIGHTS

You have the following rights regarding your data:

  • access to and a copy of your data;
  • rectification of inaccurate or incomplete data;
  • erasure in cases provided by law;
  • restriction of processing;
  • portability of data you provided where processed under a contract or with your consent;
  • objection to processing based on our legitimate interest on grounds relating to your particular situation, and objection to all direct marketing without giving reasons;
  • withdrawal of consent at any time;
  • instructions on the handling of your data after your death.

To exercise your rights, use your customer account or write to support@shop.vitaperf.com from the address used for your order; we may request proof of identity if there is reasonable doubt. We respond within one month, extendable by two months for complex requests (we inform you in that case).

Certain transactions may be analysed automatically by Stripe to prevent fraud. If your payment is declined, you may contact Customer Service to request a review.

If you believe your rights are not respected, you may complain to the CNIL: 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.

9. SECURITY

We implement appropriate technical and organisational measures: encrypted connections (HTTPS), access controls and restrictions, secure Stripe payments and confidentiality obligations imposed on our providers. If a data breach is likely to create a high risk for you, we inform you as required by law.

10. MINORS

The Site is for adults only. We do not knowingly collect data about minors. If you believe a minor has provided data, contact us so we can delete it.

11. POLICY CHANGES

We may update this policy, particularly following changes to the law or our processing. The current version is the one published on the Site with its date. For significant changes, we inform you and request fresh consent where required by law.

Navigation measurement with Microsoft Clarity

We use Microsoft Clarity to analyse browsing on our public pages. Text and fields are masked in recordings. Funnel, step and A/B test markers and a pseudonymous browser identifier allow us to study journeys without transmitting your name, email address or telephone number as custom markers. Clarity may use analytics and advertising cookies to link browsing across pages and visits.
